1. Acceptance of Terms

By accessing or using SickFade ("the Service"), including the website at sickfade.com, the mobile application at app.sickfade.com, and any related tools, calculators, APIs, or content (collectively, "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Service.

These Terms constitute a legally binding agreement between you and SickFade. We may update these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

SickFade provides sports betting analysis, expected value (EV) calculations, player prop picks, bankroll growth projections, and related tools based on statistical models and data analysis. The Service is intended for informational, educational, and entertainment purposes only.

SickFade is not a sportsbook and does not accept, process, facilitate, or intermediate any wagers, bets, or gambling transactions of any kind. We are strictly a data analytics and information service. Any actual betting you choose to do is conducted entirely through third-party licensed sportsbooks, and SickFade has no involvement in, control over, or responsibility for those transactions. SickFade is not affiliated with, endorsed by, or partnered with any sportsbook unless explicitly stated.

3. Eligibility

You must be at least 21 years old (or the legal gambling age in your jurisdiction, whichever is higher) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

You are solely responsible for determining whether your use of the Service and any related sports betting activity is legal in your jurisdiction. SickFade makes no representations or warranties that the Service is appropriate or available for use in any particular jurisdiction. The availability of the Service does not constitute an offer or solicitation in any jurisdiction where such activity is prohibited by law.

4. Not Financial, Investment, or Gambling Advice

Nothing on the Platform constitutes financial advice, investment advice, gambling advice, or any other form of professional advice. All picks, projections, analysis, and information provided by SickFade are opinions based on statistical models and should not be relied upon as the sole basis for any betting or financial decisions.

You should consult with a qualified professional before making any financial decisions. SickFade expressly disclaims any responsibility for decisions you make based on the information we provide. You assume full responsibility for any and all bets you place, regardless of whether they were influenced by our analysis.

5. No Guarantee of Results

SickFade does not guarantee any profits, returns, or positive outcomes from using our picks, analysis, projections, or any other feature of the Service. Sports betting inherently involves substantial risk of financial loss, and you may lose some or all of the money you wager.

Past performance of our picks, models, or any displayed statistics (including win rates, ROI figures, edge percentages, and historical records) is not indicative of future results. Statistical models can and do experience periods of underperformance, and model accuracy may change over time due to changes in sports, player availability, market conditions, or other factors beyond our control.

Any performance figures, projections, or statistics displayed on the Platform — including but not limited to win rates, ROI, edge percentages, and bankroll growth estimates — are based on historical data and mathematical models. They represent theoretical or historical outcomes and should not be interpreted as promises, predictions, or guarantees of future performance.

6. Bankroll Calculator and Projections Disclaimer

The bankroll growth calculator and any related projection tools provided on the Platform are mathematical illustrations only. They use the Kelly Criterion and other formulas to estimate theoretical outcomes based on the inputs you provide. These projections:

  • Are not predictions or forecasts of actual results you will achieve
  • Assume consistent bet sizing, edge, and frequency over the entire projection period, which is unrealistic in practice
  • Do not account for sportsbook account limitations, bet restrictions, or account closures, which are common in the industry and can materially impact your ability to place bets at the sizes and frequencies modeled
  • Do not account for changes in line availability, odds movement, or market conditions
  • Do not account for variance, drawdowns, or the psychological impact of losing streaks
  • Do not account for taxes on gambling winnings, which vary by jurisdiction
  • Do not account for the possibility that our models may lose their edge over time
  • Assume you have the discipline to follow a strict bankroll management strategy without deviation

Actual results will differ — potentially significantly — from any projections shown. You should not rely on these projections when deciding how much to wager or whether to engage in sports betting.

7. Sportsbook Limitations and Third-Party Services

SickFade has no control over third-party sportsbooks and their policies. Sportsbooks may, at their sole discretion and at any time:

  • Limit or restrict the maximum bet size on your account
  • Suspend, restrict, or permanently close your account
  • Void bets or adjust lines after placement
  • Change their terms of service, odds, or available markets
  • Delay or withhold payouts

SickFade is not responsible for any actions taken by sportsbooks, including account limitations or closures. The fact that we identify a bet as having positive expected value does not guarantee that you will be able to place that bet, that the odds will still be available, or that the sportsbook will honor the wager.

Any links to third-party sportsbooks or services are provided for convenience only and do not constitute an endorsement. You use third-party services at your own risk and subject to their own terms and conditions.

8. Responsible Gambling

SickFade strongly encourages responsible gambling practices. You should:

  • Never bet more than you can afford to lose
  • Set strict limits on the time and money you spend gambling
  • Never chase losses or increase bet sizes after a losing streak
  • Never borrow money to gamble
  • Take breaks and avoid gambling when emotional, stressed, or under the influence
  • Be honest with yourself about whether gambling is negatively impacting your life

9. User Responsibilities

By using the Service, you agree that:

  • You are solely responsible for any bets you place and any resulting financial gains or losses
  • You will comply with all applicable local, state, federal, and international laws regarding online gambling and sports betting
  • You will not use the Service for any unlawful purpose or in violation of any sportsbook's terms of service
  • You will not redistribute, resell, or share paid content from the Service without authorization
  • You will not attempt to reverse-engineer, scrape, or otherwise extract our proprietary models, algorithms, or data
  • All information you provide to us (including account registration) is accurate and truthful

10. Intellectual Property

All content on the Platform — including but not limited to picks, analysis, models, algorithms, software, calculators, graphics, text, and branding — is the intellectual property of SickFade and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

11. Subscription, Billing, and Refunds

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize SickFade to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then. Refunds are generally not provided, as the Service delivers digital content immediately upon purchase. Refund requests may be considered on a case-by-case basis at our sole discretion.

SickFade reserves the right to change pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle, and we will provide reasonable notice before any price increase.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

SickFade does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from using the Service will be accurate, reliable, or profitable; (c) any errors in the Service will be corrected; or (d) the Service will meet your expectations or requirements.

We make reasonable efforts to ensure the accuracy of our data and analysis, but we cannot guarantee that all information is complete, current, or free from errors. Odds, lines, and market data may be delayed, inaccurate, or unavailable at any time.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SICKFADE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT SICKFADE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT SICKFADE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL BE ZERO DOLLARS ($0). YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK. IF ANY JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY TO THIS EXTENT, SICKFADE'S LIABILITY SHALL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY LAW.

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. SPECIFICALLY, SICKFADE IS NOT LIABLE FOR ANY GAMBLING LOSSES, BETTING LOSSES, OR FINANCIAL LOSSES YOU INCUR, WHETHER OR NOT SUCH LOSSES RESULTED FROM YOUR USE OF OUR PICKS, ANALYSIS, PROJECTIONS, OR OTHER CONTENT.

14. Indemnification

You agree to indemnify, defend, and hold harmless SickFade, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; (d) any bets or wagers you place; or (e) your use of any third-party sportsbook or service.

15. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property disputes.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration against SickFade.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the courts located in the State of Delaware.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

18. Termination

SickFade reserves the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including but not limited to limitation of liability, indemnification, and dispute resolution) shall survive.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SickFade regarding the Service and supersede all prior agreements and understandings.
